The Study On The Strategic Positioning Of The Socialist Rule Of Law With Chinese Characteristics

“Law is a state equipment,and the rule of law is a prerequisite for national governance and infrastructure.”Nowadays,rule of law is not only a major issue in China's economic and social construction,but also an unavoidable trend of China's overall development.Whether from the perspectives of the healthy overall growth of socialist market economy guaranteed by rule of law,modernization in governance relying on the rule of law,social development and cultural construction under the guidance of rule of law,or from the transition from political discourse to law-based discourse,the promotion from the socialist system of laws with Chinese Characteristics to the socialist system of rule of law with Chinese Characteristics,the expectation from a country under the rule of law to a society under the rule of law,etc.all of these demonstrate that the rule of law guides the way for China's construction and development.It's essential for the overall modernization of governing system and governance capacity to grasp the great significance and profound meanings of socialist rule of law in China from the perspective of the overall situation of the strategy and carry out strategic deployment for rule of law in the long term.Since the 15 th National Congress of the Communist Party of China put forward the strategy of governing the country according to law,the rule of law principle has been a strategic issue of modernization program.The 18 th National Congress of the Communist Party of China established the rule of law as the fundamental mode for governance,and the 3rd Plenary Session of the 18 th Central Committee put forward the new strategy of law-ruled China construction.The 4th Plenary Session of the 18 th Central Committee formally proposed the term as socialist rule of law with Chinese characteristics.The strategic choice and construction of China's rule of law has been fully established and kept moving forward.Therefore,in order to achieve the goal of building socialist system rule of law with Chinese characteristics in a comprehensive way and building a country under the rule of law,measures being taken in accordance with the decisive elements of the development strategy and rooted in current situation in China,we carry out the strategic positioning of the socialist rule of law with Chinese characteristics with the rule of law widely-expanded,the national major deployment arrangements confirmed and guaranteed to implement on "comprehensive rule of law","building the rule of law in China","build a great country under the rule of law”.The thesis is based on the mainstream of strategic positioning direction of the rule of law,and is taken “to clear strategic positioning object-to confirm the strategic positioning of the premise-to establish a strategic positioning point-to achieve strategic positioning intent ” as a logical structure.The full paper consists of four chapters : The first part introduces the concept of the socialist rule of law with Chinese characteristics to clarity the central issue of this thesis,establish the target of strategic positioning and lay a solid foundation of the strategic positioning of the rule of law.The second part takes the strategic theory as the perspective,analyzes the strategic implications of the socialist rule of law with Chinese characteristics by combining history and theory,in order to make clear the strategic significance of the socialist rule of law with Chinese characteristics and establish the basic premise of the strategic positioning of the socialist rule of law with Chinese characteristics.As the body part of the thesis,the third part,based on strategic power,strategic focus,strategic orientation,strategic representation of four core factors that influence implementation of the strategy,carries out all-round strategic positioning for the socialist rule of law with Chinese characteristics according to subject,development,value,discourse,and illustrates that the important position of the rule of law as a strategic deployment to promote the cause of socialism with Chinese characteristics.The fourth part points to the four-dimensional strategic position of the rule of law,and tries to put forward the realistic countermeasure and the choice path of realizing the strategic intention of our country's rule of law in view of the current dilemma faced by the rule of law construction in our country.By strategically analyzing socialist rule of law with Chinese characteristics from the perspective of theory and practice,the thesis attempts to figure out reasons for the rule of law as a strategy,measures to implement the strategic layout,and realization of the strategic selection and planning.
