All along,food safety issues are a hot topic of great concern to society.In order to effectively protect food safety,on February 28,2009,the National People's Congress considered and adopted the Food Safety Law of the People's Republic of China and revised the Food Safety Law in 2015,and at the legal level,established food production Business license,food safety risk assessment,food production and management sampling,food recall system,the food production and operation of the whole process of supervision.In these systems,the food recall system is the last barrier to food safety.Although the "Food Safety Law" in the legal liability,in violation of the "Food Safety Law" behavior,provides administrative penalties,administrative coercion and other measures,but this is a violation of legal obligations,the adverse consequences of the ex post punishment,The role of prior risk prevention is not significant.Therefore,there is a need for a system to play a role in prior risk prevention and to avoid the widening range of adverse consequences.Food recall system has such a role.Order of the recall system as part of the food recall system,the role of the food recall system is of great significance.Unsafe food order recall system,its role is not limited to a way as a food recall initiated,but also to promote food production operators to take the initiative to recall unsafe food deterrent.And the current order to recall the system there are many problems,affecting the role of play.Unsafe food ordered to recall,from the recall to the completion of the implementation is a complex process,often produce a series of problems,such as the recall of the standard,recall procedures,recall the handling of unsafe food.The rational solution to these problems is the key to ensuring the smooth recall of food.In this paper,the issue of unsafe food recall is placed on the background of food safety.From the perspective of administrative law,the administrative rewards of food recall will be discussed,and the recall will be defined as one And then analyzes the distribution of authority in the process of recalling the implementation process.At the same time,it puts forward the procedure of regulating the main body.In this paper,from the perspective of administrative law,so that the implementation of unsafe food order recall more perfect,with a view to the comprehensive establishment of the system will be beneficial.
