A Study On "Land In The Cities Owned By The State"

On December 4,1982,the Fifth Session of the Fifth National People's Conference passed the newly-revised Constitution of the People's Republic of China.Compared with constitutions promulgated after the founding of PRC,one of the most prominent features of the constitution in 1982 is that it explicitly stipulates "land in the cities is owned by the state" for the first time.However,with the rapid development of economy and society,the seemingly unimpressive stipulation not only brings a lot of problems in theory and practice,but severely affect the stability of the state,the development of the economy and the harmony of the society.Therefore,how to accurately grasp the connotation of this article in theory,and how to effectively adopt it in practice has become an imperative problem to be solved at the present stage.By reviewing historical reforms of ownership of urban land after the founding,this thesis makes a deep analysis to the basic connotation,legitimate base and existing problems of "land in the cities is owned by the state".After comparative study on native chieftain system in domestic and abroad,this thesis has found the explanation in constitution can effectively solve the problem in Paragraph 1 Article 10 in the constitution,which can be used to better service for the development of the state and the needs of society.
