Research On Problems And Countermeasures Of Civil Filing Registration System In China

As the further development of social-political, economic and further change of cultural concept request,the eighteen raised the rule of law to an unprecedented height, a new round of judicial reform started, the filing system reform is one of the important content—reform of China filing system has been identified filing registration system, in other words, our country is now at an important stage of the filing review system steering the filing registration system,the filing registration system has not been truly implemented, the discussion between practitioners and theorists of how to implement the filing registration system is heating up again.In recent years, the number of national civil cases has grown rapidly, the civil cases has become the most cases type the people court accepts, and also the case type that is most closely combined with the life of our citizens, with a great representative. This paper selected the civil cases of first instance file system as the research object, perfecting the civil structure as a research perspective, and the protection of the right to appeal as a starting point, learning from foreign experience, and in three parts to discuss problems and countermeasures in the applicability of civil filing registration system encountered: the first part is an overview of civil filing registration systems, inspects filing registration system from the perspective of filing system, introduces and analyzes civil filing system represented by major countries of two important legal systems, and to explores the revelation which foreign civil filing system provides for the implementation of civil filing registration system in our country; second part is about the problems that the applicability of civil filing registration system will face, mainly by analyzing the current legislation concerning civil filing system in our country, the existing defects and their causes to reveal the problems; the third part is about the countermeasures of the applicability of civil filing registration system, on the basis of the first and second portions,combined with the existing foreign mature and available experience, on the requirements that eighteen puts forward implementing the filing registration system, proposed changes to clarify the internal logic of the litigation structure, and the adjustment of the lawsuit system and the construction of supporting system and adjusting, etc. The conclusion of this article restates the necessity of research on problems and countermeasures in the applicability of civil filing registration system encountered again.
