The Emperical Study Of Recidivism Governance

2010-2014,the average number of criminal cases registered by national polices exceed 6 million,and had an average annual growth rate of 2.4%,which accounted for a considerable proportion of recidivism cases.Recidivism is considered to be undesirable,it is a second violation of the order,security and justice of law.According to the research on foreign related empirical studies,more than 70% criminals returning to society committed recidivism,which indicated that,due to the impact of multiple factors and comprehensive control,the recidivism control is a complicated system engineering,showing that the current correction and effectiveness to punish crime countermeasures as the orientation of the need to be re evaluated as well.Therefore,this article attempts recidivism phenomenon and governance as the theme,along the analysis of observation,analysis and test and ideas to solve the problem,in order to describe the phenomenon of crime,to reflect on crime countermeasures,and puts forward the improvement strategies beneficial.This paper is divided into four parts,the first chapter is the origin of the problem,this part of the background of the selected topic,the definition of the topic,literature review,significance and ideas,etc.The second chapter is about the methods and materials.This chapter gives a description of the sample source,representative and research methods.The third chapter is the core of this paper,which is the empirical research on the status quo of recidivism.The internal structure and the external connection of the recidivism is the basis of the analysis of the mechanism of recidivism and formulating the preventive and restraining strategy.Through collecting the all reports given by S District in C Province in the last five years,the author use correlation analysis,interaction analysis methods to find the recidivism tend to be economic crimes,for example,it usually is drug trafficking,theft and others.The behavior primarily violates private interests,includes non violence,maintains minor crimes with showing "a-low and three-high" characteristics.In terms of penalty,92% of criminals were sentenced to imprisonment,the average term lasting 16.35 months.The 93.3% of people get a fine,the average amount being 3248.1 yuan.On the coupling of the crime of before and after,the crime shrink to trafficking in drugs and theft.The "Inertia effect" of habitual crime is the most significant among the first offense,adjacent crime and habitual crime.Overall,the initial crime was given the heaviest penalty,and punishment quantity of recidivism gradually decline with the increase in the number of crimes.The fourth chapter is the theory part,in this part,through the review of the existing recidivism prevention and control measures,propose amendments to the possible direction of specific crime again.Accordingly,the control of recidivism should adhere to the idea ——"Multi Center,Multi Node” and “Feedforward control”.Looking on the criminals as the longitude,different stages of the illegal act as the weft,so as to realize the crime controlling from the process to the result.
