Study On Legal Regulation Of Agricultural Chemical Input

Agricultural chemical inputs are at the source of agricultural production,and agricultural chemical inputs directly affect the quality and safety of agricultural products.At present,China's agricultural chemical inputs use a large problem,blind use,overuse,inefficient use and illegal use of the problem is more prominent.Although the legal regulation of agricultural chemical inputs has been basically established,there are still some problems in terms of laws and regulations,supervision system and accountability.Therefore,it is of great significance to strengthen the research on the legal regulation of agricultural chemical inputs.In addition to the introduction and conclusion,the main content is composed of three parts.The second part makes a brief review of the legal regulation of agricultural chemical inputs in foreign countries,and the third part is the author from the aspects of perfecting laws and regulations,supervision system and responsibility system.And put forward the suggestions on perfecting the legal regulation of agricultural chemical inputs in China.In the first part,on the basis of clarifying and defining the concept of agricultural chemical inputs,the existing laws and regulations on adjusting agricultural chemical inputs are summarized,and the relevant legal systems of agricultural chemical inputs are introduced.Based on the above,this paper analyzes the problems existing in the legal regulation of agricultural chemical inputs.In the second part,the author makes a brief investigation on the regulation of agricultural chemical inputs in the United States,the European Union,Canada and Japan,analyzes the experience of the above-mentioned countries and regions in the regulation of agricultural chemical inputs,and obtains the law of agricultural chemical inputs Regulatory revelation.The third part puts forward the suggestions on perfecting the legal regulation of agricultural chemical inputs from three aspects: perfecting laws and regulations,perfecting the supervision system and perfecting the responsibility system.First,it is proposed to revise and supplement the relevant laws and regulations from the three aspects of perfecting relevant laws and regulations,formulating supporting laws and regulations and strengthening the formulation and updating of relevant standards.Second,through the market access system,the use of agricultural chemical inputs regulatory system and the improvement of public participation system,so that agricultural chemical inputs supervision system is improved.Thirdly,from the clearresponsibility of the main body,the principle of clear liability and the guarantee responsibility to achieve three parts,to make the agricultural chemical inputs responsibility system is improved.Through the improvement of retrospective system and play the role of public interest litigation to promote the realization of responsibility.
