The Legal Regulation Of The Administrative Illegal Information Publicity

As a new type of information regulation tool,The administrative organ can effectively deal with the contradiction between the numerous administrative tasks and the limited law enforcement resources,regulate illegal acts,maintain social order,and promote the transparency of government work,by publishing the illegal information.However,its application and development in our country are still at the initial stage.Due to the lack of legal norms and the improper exercise of administrative discretion,the problems have arisen in the concrete implementation process.This paper attempts to define the connotation and nature and explore the path of legal regulation of the illegal information publicity through the analysis of it’s status quo,current laws and regulations,and specific cases.This paper is divided into five parts,the framework is as follows:The first part,it’s the brief introduction to the topic selection,the overall review of domestic and foreign research,and the writing ideas,methods,and significance of this paper.The second part,explain the connotation of the illegal information publicity by analyzing the views of different scholars and combining with its characteristics at first,then collate relevant legal provisions and explain its specific problems in the implementation process.The third part,three cases are introduced to illustrate the possibility of legitimate rights infringement of the illegal information publicity.On this basis,analyze its legitimacy.The fourth part,analyze the legal issues involved in the illegal information publicity,expound the application of the principle of legal retention and the balance of public interest and private interests according to different types of the illegal information publicity.The fifth part,find a legal regulation path of the illegal information publicity through the improvement of legislation,the strengthening of the administrative self-control and the judicial review.
