The application of the provisions of the Labor Contract Law in China,either the worker or the employer,have taken a single subject model,lack of pertinence and diff icult to cover the comprehensive industrial relations,the formation of legal protection to the phenomenon of one size fits all,leading to the main body for the protection of t he rules of the imbalances,deviated from the meaning of labor contract law tilt protec tion principle,the system established by the law,in reality according to different level s and different size,different groups,unit of choose and employ persons is selectively perform or comply with the dilemma.The application of the provisions of the Labor Contract Law law hierarchical level in laborer stratum,unit of choose and employ persons level,and categorizes more targeted in law subjectrom "one size fits all" adjust ment mode to typed mode,Is the way of solving these problem that lead to actual oper ation condition of labor contract law and labor contract law subject not effectively adj ust.Through this article was carried out on the subject of the Labor Contract Law to th e legislative design,according to the employers design the exemption of small and me dium-sized enterprises and medium-sized enterprises and special design for laborer le vel,in the practice of the system design and adjustment of medium measure suggested trying to solve the legal problems.
