The Legal System Of Genetically Modified Food In Our Country

With the development of biotechnology,people's lives are unconsciously influenced by vigorous growing science and technology. The transgenic technology, known as " the second green revolution" in the 20th century, is the important results of biotechnology, which largely resolved the food and energy crisis resulting from the rapid population growth. However, due to the potential uncertainty of transgenic technology, the security issues aroused long terms of attention from its birth. Therefore, the legal issues of genetically modified food research, has become an unavoidable task of the domestic legal workers.The paper is divided into five chapters.Chapter ? is the introduction, the main contents of the research background of genetically modified food, which includes domestic and foreign research present situation and research significance.Chapter ? provides an overview of genetically modified foods, from the point of view about transgenic technology, briefly described the concept of genetically modified foods, the classification and security features, elaborated the protection of consumer's food safety authority, consumer's right to know and choose, and human right to health and environmental rights.Chapter ? mainly introduces the development status of transgenic crops, especially elaborated the GM food law system in the American, European Union and Japan. The GMO regulations, management mechanism and the specific rules, which adopted in countries with different legislative modes, such as the American, European Union and Japan, can provide references for our country.Chapter IV is the focus of this paper, the main contents are as follows: from the point of laws and regulations, management mechanism and the specific regulations, introducing the current legislative status about genetically modified food in China, and dissecting the defects of our current legislation in the legislative level, management system, the legislative concept,identification system and detection system etc..Chapter V is about perfections of the legal system of genetically modified food,which discussed the countermeasures to improve our legal system of genetically modified food,recommended the formulation of specialized comprehensive laws and regulations about genetically modified food to improve the labeling system, supervision and inspection system and the compensation system of genetically modified food in China.
