Empirical Study Of Districts And Cities' Legislative Activities

Districts' legislative activities are regarded as the expansion of the subject of local legislation, and it is the refection of the will of the people, a good way for citizen to join in the public affairs, matching with the path of constitutional self development,and also a significant way for cities to self management. With the introduction of the amendment to the legislation law, cities in China are beginning to have local legislative power. By then, the country's 282 districts and cities begin to gradually carry out the preparation of legislation, formal legislation, and the legislative perfection. Then, it's worthy of our attention that how the cities in china start their legislative activities. So this paper is based on the proposition of "districts' legislative activities", taking 17 districts and cities in Guangdong Province as samples, and making the empirical analysis on the three stages of legislation of the 17 districts, that is, preparation of legislation, formal legislation, and the legislative perfection. In accordance with the principles of democracy, science, rule of law and local characteristics, the author initially reveals the existing problems and explores the reasons, and then puts forward some suggestions on how to improve the legislative activities of the districts and cities based on what the prospect of the legislation of the districts and cities should to be.There are five parts in the paper:Part One: the Introduction, having discussed the background and significance of the research, the objects of the study, and the research methods and the innovation of the path of the 17 districts of Guangdong Province.Part Two: the general theories of the legislative activities of the district and city,that is, what the prospect of the legislation of the districts and cities should to be. First,discussing the theoretical basis, legal basis and practical basis of the legislation of the district and city, this paper tries to prove the legitimacy of the legislation of the city.Second: Based on the legislative status and functions of the district and city, this paper sums up the characteristics of legislative activities. Third, the three aspects of the legislative activities of the district are defined: Legislative preparation, formal legislation and legislative perfection. At last, On the basis of the previous three sections, this paper demonstrates the principles that should be followed in the legislative activities of the District, which are the general legislative principles of science,democracy and rule of law, and the principle of local characteristics.Part Three: the empirical study on legislative activities in Guangdong Province,that is, what is it. Through the data and charts, this paper objectively describes the legislative activities of 17 districts and cities in Guangdong province.Part Four: the problems and reflections on legislative activities of the cities. The author concludes that the legislative activities of the district have problems in the scientific, democratic and local characteristics of legislation. And the author thinks the reasons are: the legislative consciousness of the leading organs of the legislative activities and the Legislature are backward; some benign legislative mechanism runs out of order; and the laws and regulations are not scientific.Part Five: the suggestions on perfecting the legislative activities of districts and cities. The legislative activities of the district and city have the characteristics of independence and autonomy, and the legislative activities should follow the principles of science, democracy, rule of law and local characteristics. So, the way to make a scientific local legislation is that: establish a correct sense of legislation and the concept is fundamental, the normal operation of the legislative mechanism is the support and the rational allocation of local laws and regulations is the key.
