On The Inevitable Trend Of Legalizing Same-sex Marriage

In today's society,people are no longer unfamiliar with homosexuality.It has become a very common social phenomenon.Moreover,the protection of human rights in the world is becoming more and more perfect,and the laws of each country are beginning to give more rights to homosexuals.As a product of nature human nature,homosexuals can not be self determined,so they can not regard sexual orientation as different from the majority and regard it as a kind of fault.At present,China has realized the non pathology of homosexuality,the same as China's citizens,homosexuals and heterosexuals should be equal before the law,the marriage right should also be the case,the law should allow same-sex couples together,give them rosexual couples the same rights and obligations.This paper is divided into five chapters,the first chapter describes the nature of same-sex marriage,first marriage are summarized,and briefly analyzed the social basis of marriage and family relations,lists several definitions of the nature of the marriage theory,China's current use of the "identity theory".Then,the phenomenon of homosexuality is analyzed,briefly describes the history of homosexuality at home and abroad,as well as people's attitude towards it.Finally,put forward the legalization of same-sex marriage is one of the ways to protect human rights;the second chapter puts forward the realization of China's legalization of same-sex marriage problems,expounds the attitude towards homosexuality in china.There are pros and opposition to whether same-sex marriage can be legalized,but the majority are now opposed.There are still hindering the moral and ethical aspects,the legalization of same-sex marriage on the road full of thorns,to achieve the legalization of same-sex marriage is very difficult;the third chapter is the comparative analysis of the legislation at home and abroad through same-sex marriage,why to solve existing problems,so as to realize the legalization of same-sex marriage;the fourth chapter from the two aspects of the necessity and feasibility analysis of why China should realize the legalization of same-sex marriage,the feasibility from two aspects of theory and Practice on the basis of detailed analysis.Come to our country to achieve the legalization of same-sex marriage has the good social basis;the fifth chapter puts forward some suggestions on how to realize the legalization of same-sex marriage,namely through progressive legislation,first eliminate people for homosexual discrimination "anti discrimination law" enacted,then making same-sex couples "law" as a transition,let people gradually accept same-sex unions,and finally realize the "gay marriage law" promulgated,finally realize the legalization of same-sex marriage.
