With the rising voice of human rights in the world,homosexuality as a kind of social subculture is concerned increasingly by the countries around the world.22 countries and 40 areas have regularized the same-sex marriage.However,in many countries including China,the public still hold the concept that marriage must be a combination of a man with a woman.Then they condemn homosexuals and disagree with same-sex marriage.The phenomenon of excluding the homosexuals provides them a depressive environment to live which results in a series of society problems.In order to study China's legalization of same-sex marriage deeply,We investigate the attitudes of the public on homosexuality and same-sex marriage through the questionnaire survey,and have done a lot of theoretical researches and data analysis.The surveys analyze the obstacles and feasibility of the legalization of same-sex marriage in China.To provide the beneficial reference of the legislation of same-sex marriage for China,the survey pays more attention to the same-sex marriage legislation of foreign representative models emphatically and summarizes the advantages and disadvantages by comparing and analyzing the data.Finally,it is concluded that the legalization of same-sex marriage in China still needs more time.Never hope to achieve quick results and proceed it in an orderly way.The government should gradually expand the scope of the rights of the homosexuals and put forward some legislative ideas to improve the same-sex marriage in China.First make out gay rights and interests protection law as soon as possible,then carry out same-sex partner law at the appropriate stage to protect the legitimate rights and interests of homosexuals to content their wishes of marriage and family.And under a appropriate condition,writing same-sex marriage into marriage law to achieve no differences of marriage rights between homosexuals and heterosexuals and the real equality of human rights.
