Restaurant-kitchen waste is a general term for food residual,food processing waste,and the waste edible oil.Restaurant-kitchen waste is a kind of "public nuisance",so improper disposal will not only cause serious pollution to the environment,but also cause serious threats to public health.However,restaurant-kitchen waste is also a kind of resource,which can be recycled.Proper utilization of restaurant-kitchen waste is not only beneficial to the protection the environment,but also can effectively reduce the pressure caused by the shortage of resources.Also,the recycling of resources can be realized in this way.The separate legislation of restaurant-kitchen waste management is the only way to control the whole process of restaurant-kitchen waste disposal effectively.Taiyuan started legislation of restaurant-kitchen waste management rules since 2011,and Taiyuan Municipal People's Congress Standing Committee included it in the annual legislative plan from the begin of2016.It was voted through in December,2016,and finally it approved by the Twelfth Meeting of the Standing Committee of the Shanxi Provincial People's Congress on the thirty-seventh in March,2017.Taiyuan Restaurant-kitchen Waste Management Regulations is discussed and modified many times in the process of legislation,but it still has several remained issues,such as the improper arrangement of legislative purpose levels,the inaccurate regulations of legal application scope and implementing subjects' authority,the imperfect system design and the legal obligation issues.Aiming at the issues in the regulations and the controversies that occurred in the process of the restaurant-kitchen waste legislation,this paper puts forward the following proposals: the legislation purpose for food safety guarantee should be placed before the maintenance of urban and rural appearance and the environmental sanitation on the basis of some other cities' experience;the space scope of application is determined as the city's six municipal districts;those operators who hasnot been granted or registered should be brought into the object scope of application;the authority of every subject of law enforcement should be established clearly to prevent the conflicting policies from different departments;the restaurant-kitchen waste management regulations should be perfected through the establishment of garbage sorting recycling system,in-place disposal system,the canceling of restaurant-kitchen waste charging system and the perfecting of information disclosure and public participation system;the implementation of the regulations should be ensured by increasing the law enforcement subjects' obligations.
