Research Of Hearing System Of Administration In China

Hearing system of administration is the core of modern administrative procedural law system.It is the product of the development of modern democratic politics and it is an effective measure to improve decision-making mechanism by law,and it guarantees citizens can participate in the decision-making of public affairs effectively.In 1996 the hearing system of administration was introduced by law of administrative punishments in our country for the first time.Its scope is expanding.It is playing an important role in promoting administrative democracy and protecting the lawful rights and interests of administrative relative person.But we should also see,there are a lot of problems in our country's hearing system of administration which are not only in legislation but also in the process of actual operation.To a certain extent it affects the healthy development of hearing system of administration.This paper which analyzes the hearing system of administration in our country including six parts:The first part is introduction,which mainly introduces this article's background,purpose,meanings,research method,and new opinions that may appear.The second part is theoretical research,illustrating the theory of the hearing system of administration.It introduces the concept of hearing system of administration and its generation and development simply,analyzing hearing system of administration from jurisprudence,and discusses its basic principle.The third part discusses the present situation of the hearing system of administration in our country.We can find some problems of the hearing system of administration in China by elaborating the current situation,such as the lack of legislative aspect,the narrow hearing scope and irreasonable system,etc.And it analyzes the causes of the problems.The fourth part mainly introduces the hearing system of administration of the developed countries such as America,Japan,Germany etc,and it is mainly pay attention to the hearing scope,the hearing presider and the hearing represent.It summarizes several enlightenments to the hearing system of administration in our country through comparison and reference.The fifth part is about some suggestions to perfect the system of administrative hearing in China by discussing and analysising experiences from foreign countries in practice.The sixth part is conclusion,which summarizes the whole article.
