Along with the public in our country gradually increasing the awareness of democratic and rights and rule of law,public demand participate in political increasing strongly,and because of the social interests polarize severely,the social contradictions complicated.These make all aspects of our society need the public participate actively,meanwhile,China's reform has entered to difficult phase,involved in adjustment the interest of all aspects,particularly in relation to adjust the interests of the vested.So the public's active and creativity participation has become the fundamental driving force of the reform and opening up.If the reform of every aspects the public don't participate actively,the reform in China will be difficult to achieve legitimacy.This article according to the theory of people's Sovereignty and Participatory democracy and governance and new public management,these theory are the theoretical basis of public participation in local legislation.This article also analyses the normative basis of public participate in local legislation in our country.The public participate in local legislation achieved considerable achievements,and created a variety of ways and means to participate,such as legislative Forum,whole country discuss.Written comments,discussion meeting.Legislative hearings,letters and visits and calls,network participation,attend the legislative council,and so on.Particularly the establishment of the legislative hearing system,it make public have direct way to participate in local legislation and have the opportunity to directly communicate with legislative workers.But the public participate in local legislation is still deficiency,they are manifested in the local legislature was dominant too much,public participate in local legislation are largely arbitrary.Mostly involved in disorder,the enthusiasm and initiative of the public participation in local legislation is not high,the awareness and the degree of participation in local legislation are inadequate and the ways of participation are considerable single.The main reasons are mainly include political and democratic system are imperfect,the conditions of socioeconomic develop restraint,the causes of public participation psychological and the legal knowledge are deficiency.Particularly because of lack of the mechanisms of public participation lead to public participate ineffectively.This article also analyses the characteristics of the mechanism of public participation in local legislative the United States and its implications,and put forward the measures to improving the mechanism of public participation in local legislative,Improve the mechanisms of public participation in local legislation the specific system must be established in the following areas: first,to establish the system of public participation in legislative initiatives,including establish a platform for public initiative Legislative program and the registration system of legislative initiative program;second,improve the public announcement system of local legislation;third,improve the legislative hearing system;fourth,improving the supporting system of the mechanism of public participation in local legislation,it consist of strengthen the communist party's leadership core and the role of hearing public opinion,strengthen and improve local people's congress system,strengthen civic education and enhancing the awareness and the competence and the confidence of citizen participation,In short,it is not an easy task to establish the mechanism of public participation in local legislation in china,it need all the patience and hard work,involve in the leaders' wisdom and establish the idea of the public is the main part,the leaders' transfer of power and innovation,the public reason and scholars' research and exploration.
