Along with the progress of the times,the philanthropy plays an important role in the modern society,has been attracting more and more attention.On September 1,2016,the newly issued The Charity Law of the People's Republic of China formally implemented,many charity behavior has the corresponding explanation and provisions.But the official explanation will be a situation,called Individual Help,left out of charity.Individual help does not belong to the charity activities,from the charity law adjustment.In recent years,the Individual Help with its spontaneity,flexibility,efficiency and other advantages to become useful addition to charities,help the living difficulties for many people,in the crisis rescue trapped and promote the development of social public utilities are playing a positive role.But at the same time,because of the lack of corresponding legal norms,Individual Help will inevitably become a convenient way of the ulterior motives,hurt the feelings of the kind people.In real life,due to improper personal help trigger disputes,the regulation of Individual Help stay in the moral level,general moral sometimes hard to restrain malicious client of Individual Help.So no matter to love for the donor and the patient itself will be a lot of damage,easy to cause considerable moral risk and negative effects.So need to put Individual Help under the law,so as to better regulate this kind of behavior.In this paper,in the act of charity cause concern about the media and Internet users after the formal implementation with typical events as the main line,combined with a series of Individual Help events,specific analysis of the problems existing in the Individual Help,discuss how to better the specification of the patient's behavior.This paper mainly includes the following three sections:The first chapter is divided into two sections.This chapter mainly by the typical case for path for help,through inductive case show the focus of the problem,in this paper to explore the Individual Help questions.The second chapter is divided into four sections.Referred to in this chapter is put forward in this paper,the concrete implementation of the Individual Help,analyzed the difference between itsand related legal concepts,summarizes the legal characteristics of the Individual Help.To a third party after the participants' behavior nature,patient privacy and the public's right to know between the contradictions and problems,and the rest in the Individual Help ownership and handling specific analysis and discussion on the key issues.The third chapter is divided into two sections.Aiming at the existing problem of Individual Help rationalization proposal is put forward,so as to guide and standardize the healthy development of the Individual Help.
