Primary and secondary schools are institutions and places for minors to receive education.School safety is related to the healthy development in mind and body of teenagers.In recent years,student safety of primary and secondary school has become one of the social hot issues of general concern in the whole society.It also inspired many scholars to use multidisciplinary,multi field perspective and comprehensive theoretical knowledge to conduct research.From the current research status,student security in non-education teaching time of primary and secondary schools becomes a new problem which worth exploring and studying.It can be regarded as an important practice in education legislation and education management.At present,China’s legal resources related to student security are extremely scarce.There is always a gap in the legislation of student security in non-education teaching time in our country,which is extremely unfavorable to the corresponding administrative practice and judicial practice.Thus,it is necessary to take the student security problem in non-education teaching time into the background of education legislation and the existing school safety laws.Our goal is to make it become important parts of the laws and establish a sound safety management and security system.In view of the public safety property of primary and secondary schools,the author researches the subject from the visual field of administrative law,starting from three conditions,To Be,Ought to Be and Being.Specifically,this paper focuses on three parts.First,the author aims at theoretical analysis of the student security in non-education teaching time,including the analysis of the relevant concepts,the administrative legal relation of related subjects,and the relative basic theories.Secondly,the author rethinks the current situation,Issues and defects of student security problem in non-education teaching time from practice perspectives.In the final part of this paper,the author combines the theory with practice,put forwards to incorporating this problem into legal documents and construct relevant systems.The author combines macroscopic idea and specific system design,takes prevention and responsibility systems as a main line,to explore how to establish relevant systems.All in all,this thesis aims to provide some very favorable reference for legislators and theoretical researchers in this area.
