A New Probe Into The Administrative Monopoly Regulating Path From The Perspective Of Supply Side Reform

China has a long history of traditional power to intervene in the economy.In this fertile soil,the phenomenon of administrative monopoly emerges in an endless stream,which causes serious damage to the fair competition in the market.Although the administrative monopoly regulation of anti monopoly law has already been included in,but the governance effect is unsatisfactory and facing difficulties.Our country chooses the path that it depends on internal administrative system to correct administrative monopoly in the alienation situation.This path is difficult to bear the heavy responsibility of governance of administrative monopoly.Under the background of the supply side reform,it is imperative to eliminate the administrative monopoly.What's more,the optimal regulation environment is great since ushered in the history.But how to seize the new opportunity of governance of administrative monopoly? The regulation path is generally applicable so as to break the administrative monopoly governance dilemma.This is the core problem to be solved in this paper.The first chapter: reflect the necessity of administrative monopoly regulation from the perspective of supply side reform.Different from The supply management advocated by western countries,supply side reform has its unique connotation in the special context of our country.Its essence is to emphasize the government role which should form the positive effect and structure optimization in terms of effective supply,or can be further said that the current round of economic reform is for the government to amend behavior that is to intervene in the market.The core is to deal with the relationship between the government and the market,let China become a normal market economy country.Therefore administrative monopoly has become an important content in the reform of the supply side.No matter from the angle of reality or a theoretical and logical point of view,to get rid of administrative monopoly in the comprehensive reform of the supply side occupies an important position.The second chapter: the institutional dilemma of regulating administrative monopoly from the perspective of supply side reform.Based on the current situation of China's administrative regulation ridge,the governance effect is unsatisfactory.Firstly,the government has serious offside in the governance of administrative monopoly.The traditional economic elite culture and the idea of "official standard" make our long-term lack of competition culture,pooling together with the government's multiple roles,the government often let out standard for compliance review.Secondly,there is the absence of competitive compliance review in the governance of administrative monopoly.The construction of our country is like a raging fire to compete in censorship,but we need more authorities' determination and perseverance from the opinions issued to implement the system.Finally,China's anti-monopoly law on the regulation of administrative monopoly is dislocative because of the limitation of the scope of regulation,the weakness of the regulatory responsibility and the weakening of the enforcement.It is difficult to bear the heavy responsibility for the anti administrative monopoly.The third chapter: the choice of administrative monopoly regulation path from the perspective of supply side reform.To break dilemma of the administrative monopoly governance in the view of supply side reform,the core is to seek a reasonable regulation path.In the current legal regulation framework,China's administrative monopoly regulation path is a closed path that relies on administrative system of internal correction.It lacks comprehensive linkage system reference.Learning from the practical experience in economic transition countries and developed countries on administrative monopoly governance path,path of China's administrative monopoly regulation should be chosen based on local resources,through a new opportunity for supply side reform,seeking the path of comprehensive linkage regulation.The fourth chapter: the path expansion and institutional innovation of administrative monopoly regulation from the perspective of supply side reform.Starting from the idea of deep into all aspects of governance of administrative monopoly,this paper constructs a comprehensive linkage type regulation path system that consists of the basic path of regulation,the pre-regulatory path,the path of pre-regulation and the path of the post regulation.The basic path of regulation--remodeling the roles of the government and the market is the governance of administrative monopoly banner.The pre-regulatory path--compliance review to eliminate the administrative monopoly acts as an advance party,making administrative monopoly strangled in the cradle.The path to pre-regulation legislation of the administrative monopoly rule is the center link,which lets the administrative monopoly into the orbit of the rule of law.the path of post regulation competition law enforcement normalization is the relief mechanism of administrative monopoly governance and the last barrier of market competition.
