| Since August 2013,China has established 11 Free Trade Zones(FTZ).The establishment of the FTA is the major decision made by the CPC Central Committee and the State Council.It is a major step of thoroughly implementing the spirit of the 18 th Party Congress,promoting reform and opening up in the new situation.According to the design of the General Program of the FTZ of the State Council,the experiment of FTZ should shoulder the goal of speeding up the transformation of government functions in the new period,actively exploring the innovation of management mode,promoting trade and investment facilitation,accumulating experiences of reform and opening up policy and exploring new ways to deepen this policy.In the early development stage of the FTZ,the administrative management system of China's FTZ is not yet mature and many problems exist.For example,the management mode of is not clear in both theory and practice,the legal system is intertwined,the management authority is unknown and the organization is overlapping.In view of the above problems,the author does researches based on the implementation of local regulations of Shanghai,Tianjin,Fujian,Guangdong and combined with China's current FTZ legal system.This paper analyzes the problems existing in the construction of the FTZ from the global point of view,and then combines the problems existing in the construction of other functional areas such as China's development zones and bonded areas.Moreover,this paper also analyzes scholars' researches on the construction mode of the foreign free trade zone management system,and tries to put forward the proposal for the future development direction of China's FTZ,including the role and functions of management committee of FTZ.After analyzing the shortcomings of the theory of administrative subject,and combing with the scholars' idea concerning public legal person,the author proposes a concept of legal public person to solve the legal status uncertanty of the management committee in FTZ. |
