On The Legal Status Of The Management Committee Of The Pilot Free Trade Zone

The establishment of the free trade pilot zone(hereinafter referred to as the free trade zone)in China is an inevitable trend to adapt to global economic and trade development.From the establishment of the first free trade zone in China,namely the China(Shanghai)Free Trade Experimental Zone,to the establishment of the seven free trade zones including the Sichuan Free Trade Zone by the Party Central Committee and the State Council in 2016,The trade zone strategy is a major measure for China to promote reform and opening up with a more proactive attitude.As a test field for deepening reform and opening up,the Free Trade Zone shoulders the important task of administrative reform and economic innovation.The Free Trade Zone Management Committee(hereinafter referred to as the Management Committee)acts as the "first-line" management organization in the region and undertakes the overall management and coordination area.The comprehensive functions of various administrative affairs within the country and the clear positioning of their legal status are key issues affecting the construction of the free trade zone.However,at this stage,the administrative management system of China's free trade zone is extremely imperfect.The definition of the legal status of the Free Trade Zone Management Committee is both confusing and inconsistent with the legal provisions,resulting in the management authority of the management committee in the process of performing management functions is unknown.A series of issues such as the responsibility of the responsible party and the lack of supervision system.Therefore,it is of great practical significance to locate the legal status of the Free Trade Zone Management Committee,and it is also the embodiment of the reform of the administrative system of the Free Trade Zone.This paper hopes to analyze the legal status of the Free Trade Zone Management Committee from the overall situation of the legal status of China's Free Trade Zone Management Committee and analyze the legal status of the Free Trade Zone Management Committee.The problems and causes are based on the applicable laws and regulations of China's free trade zone construction,combined with the academic research results on these issues,and drawing on some successful experiences of extraterritorial countries.On the one hand,the legal system can improve the upper law,and the other On the theoretical level,new theories can be introduced to solve the legal status of the Free Trade Zone Management Committee and remove obstacles for the construction of China's free trade zone.
