Research On The Legal System Of The Quality Assurance Of Construction Projects In China

In order to adapt to the improvement of the socialist market economy as the direction,to improve the overall quality level as the goal,to develop the quality of survival of the fittest competition mechanism as a means of engineering quality assurance system of law,is the problem to be solved.This paper,we take the empirical analysis method,with the extensive development of the quality promotion as the breakthrough point,to analyze the implementation of the project quality control in our country,and the implementation of the project subcontract illegal subcontracting behavior.Secondly,the paper use normative analysis method,on China's current legal system of engineering quality assurance level division,and analyse the five parties lifelong responsibility system,quality supervision system,the completion and acceptance of the filing system,quality guarantee system,quality insurance system and other five systems,expounds its content.And,this paper on China's construction engineering quality guarantee legal system and the existing problems are analyzed: the quality assurance system of laws and regulations legal validity is low,the lack of execution,overlapping conflicts and other issues,in addition,the five quality guarantee legal system mainly exists the lifelong responsibility scope of subject setting one-sided,quality supervision the management system of the implementation of power is insufficient,the completion of the filing system and weakening the government's regulatory role,contrary to the original intention of establishing the system of deposit insurance system,the quality of operational issues such as poor.Finally,aiming at the above problems,the improvement of China's construction engineering quality guarantee legal system measures,first of all,through the removal of miscellaneous repeated terms,rich new law content,gradually draft law the engineering quality,construction engineering quality insurance law,improve the quality assurance system of law;the proposed expansion of lifelong responsibility system the scope of the subject,stimulate the quality supervision system innovation,make up for the lack of acceptance and filing system,to enhance the quality and operational margin,to strengthen the quality insurance system of execution of five initiatives,in order to perfect our legal system of construction engineering quality assurance,quality control and improve the level of quality supervision,enhance quality awareness,quality behavior,which depend on the quality of survival,to seek development,seek benefits,and even seek credibility,so as to better promote economic development in the China quality.
