With the rapid development of modern economy and technology,government organization and adjustment of social life functions and powers of expanding the scope of the police power as a part of the national administrative power,discretion has also increased.At present,the absolute authority restriction behavior is almost impossible,the police power expansion for play essential initiative of administrative organ,on the other hand,is likely to abuse or misuse of citizens to encroach on the legitimate rights and interests.Therefore the proper regulation of police power,avoid becoming a runaway horse imminent.However,in the process of power operation,the use of power is too large or too small,how to determine the standard of fair use of power is still a blank in the academic circles.In the citizen's law consciousness increases ceaselessly today,the police in the enforcement process,the slightest mistake,it will arouse people's awareness of rights,with the development of further attacks on the police to enforce the law,this situation frequently reflects the unreasonable problems may exist in the process of using the power of the police.In 2012 the new "criminal procedural law","respecting human rights" and "human rights" into law as a starting point,from the national attention on the protection of human rights,in-depth analysis of problems existing in the rational use of police power and lack of current from the rule of law practice,from legislation,implementing and supporting system of power on the rational use of our police recommendations.
