The Internet especially the development of mobile Internet marks the coming of the big data era,on the one hand the virtual property permeate into every field of our Daily life,on the other hand the infringement disputes are also increasing.Network security rose to national strategic level,and It's the first time that online virtual property had been written into the general provisions of civil law.Under the condition of the above background,I analyze the basic theory of network virtual property at first,and I think that the property right of network virtual property should be clear.Secondly,I studied the Main types and characteristics of network virtual property,analysisd the current situation of legislation and application of law in China.In order to sovle these problem,I believe that we should puts forward some suggestions on the "property law" and "tort liability law" and other laws and regulations.At the same time,speed up the development of network virtual property law.It not only solves the current problems,but also plans for the future development.In the end,I referring to the relevant legislation and practice of Japan,and I suggest that we should construct online virtual property infringement dispute online settlement platform.Further more,developing of network virtual property insurance is also a good idea.and in order to remedy more comprehensive violations of virtual property rights,I think it's a practical way to arouse the enthusiasm of the majority of Internet users to protect their network virtual property rights.
