Research On The Anti-corruption Function Of Occupational Pension System Of Civil Servants

Along with the advance of the pension system,there is more and more attention to the reform of the occupational pension system of civil servants.The occupational pension of civil servants is different from the annuity of the enterprise because of the particularity of the applicable object-the national public officer.As a group exercising state power directly,the integrity of civil servants is basic professional ethics.In order to promote the construction of anti-corruption and clean government,more and more people are considering to further restrict the exercise of civil servants' power through the anti-corruption function of the occupational pension system of civil servants and realize the purpose of promoting honesty.Occupational pension of civil servants refers to the institutions and their staff participate in supplementary pension insurance system on the basis of basic old-age insurance.And the anti-corrosion function of occupational pension of civil servants,it requires public officials be clean,honest,in order to enjoy the pension benefits after retirement,or will be partially or completely deprived of retirement benefits.Through the relationship between the actual material interests of civil servants after retirement has a "clean government mortgage" role,to achieve the role of anti-corrosion and promote incentives.China's current legal norms for the provisions of the occupational pension system does not clearly reflect its anti-corrosion function,but there are a lot of relevant legal provisions,policy text,and rules of CCP related to this function.It can play an important role to enhance the anti-corrosion of occupational pension system.In addition,a number of local governments in China explored pilots in the conduct of similar systems,more in the form of clean annuity or integrity,such as honesty and integrity system in Liuyang City in Hunan Province and Jiangmen City in Guangdong Province.All of these systems are expected to urge civil servants against corruption through the establishment of similar systems.They took good results as pioneers in institutional exploration.However,due to common problems,such as the legitimacy of the question,the supporting system is not perfect and some other reasons,most systems ended in failure.Other countries or regions,such as Singapore and Hong Kong have adopted mature system of anti-corruption function of civil service`s pension.The legal regulatory content,operational mechanisms and oversight mechanisms of Singapore's central provident fund system and the Hong Kong's integrity fund system have many common rules and respective unique advantages.Combined with the background of China's civil service management and doing comparative study can be achieved for providing international reference to enhance anti-corruption function of China's occupational pension system.Occupational pension system can achieve its anti-corruption function through the rational design of the system.However,China's current lack of top-level legislative design is the biggest obstacle to its effective running.Therefore,to achieve this function,we must firstly confirm it in the high order of the occupational pension legal system.At the same time,the construction of specific content of the system is also the foundation,especially in accordance with the actual needs,such as the object of this function,the annuity payment model,the assessment of the content,punishment mechanism,incentive mechanism trigger conditions and so on.In addition,in order to make the occupational pension treatment of civil servants be effectively affected by the professional behavior of them,the occupational pension treatment must be linked to the status of clean and honest duties of civil servants.Finally,a complete supporting supervision mechanism is the protection of all the above system construction.With the advancement of the supervision system,China is exploring the establishment of a unified anti-corruption supervision organ.Unified supervision of the main body and the independent supervision of actual exercise will undoubtedly provide strong support for the running of this function,and protect the realize of anti-corruption function of our civil servant`s occupational pension system.
