The Judge Assistant System Research Of China

The judge assistant system,Both in the continental law system and the common law countries has a long history.It to improve trial quality,and the effect and promote greater fairness in the judiciary plays a very important role.But in our country,the judge assistant system is still a new thing,is in the stage of exploration,the pilot.Since the 18 th annual congress of the communist party of China,we will accelerate reform of the judicial system in our country,the 18 th annual congress of the communist party of China's fourth meeting passed on comprehensively advancing the rule of law "of the central committee of the communist party of certain major issue decision" specifically mentioned in the "promote the reform of trial centered lawsuit system",released in February 2015,the supreme people's court "the fourth five-year reform program" specialized personnel promote court system of classified management reform,establishing the judge took made rules,as one of the judge system reform in the specific number of important supporting system,the establishment of the judges assistant system in China with the international system reform step by step into the fast lane.However,under the influence of the realistic condition,the judge assistant system in the pilot appeared a series of problems to be solved in the process of practice.To regulate the behavior of judge assistant and other auxiliary to support its system reform,reform lead.In this paper,the judge took the perspective of system reform,combining with the reform of the existing experience,starting from the jurisdiction properties and judge role positioning,to clarify the legal position of the judge assistant based problems,responsibilities,management and configuration,and puts forward the specific mechanisms involved system construction,to establish and perfect the judge assistant system in China provides the beneficial reference.
