Research On Several Problems Of Judge Assistant System In China

It has been more than eighteen years since the exploration of the assistant system of judges in our country.But due to lack of unified standard and clear positioning function,lead to the courts at all levels in the process of exploring twist hands twist feet,faltering,directly affect the building of the system of judge assistant system and perfect.At present,the judicial system reform is in full swing,it should be the best time to construct the system of judge's assistant system.So in this paper,the judge assistant as the research object,through the review of the background and development process of the judge assistant,summarizes the design idea,clear existence value,in this paper,the reform present situation,put forward the problem,put forward to perfect the opinion.This article is divided into four parts,the first part introduces the origin of the judge assistant system and the background and historical development of the assistant system.The author believes that the background and historical development process of the full control of the judicial assistant system is the basis of theoretical research.The second part is to study the design concept and value of the assistant system.By introducing the theoretical basis of the judge's assistant system and the analysis of value,the necessity and urgency of perfecting the assistant system of judges in our country can be clearly improved.The third part is the analysis of the current judicial system reform the judge assistant system existing problems.Because only definite current system exists the malpractice,can be in the following the pertinence to put forward the countermeasure.This section will respond to the comments in chapter.The fourth part is to study and improve the assistant system of judges.This part will resolve the problems existing in the judicial assistant system in the third part.The author will give Suggestions on the application of the proposals in the current judicial system reform,the Suggestions on the modification of relevant laws and regulations,and the Suggestions on the application of the judge assistant's own construction.
