As the global marketing and free trade grow rapidly,the traditional tariff and non-tariff barriers are getting weaker.Newly emerged non-tariff ones-Green Barriers is an unavoidable consequence of global marketing development.The analysis on Green Barriers should be based upon current global marketing development and its future trend.Even though green barriers benefit the global market and fulfill the sustainable development from the long run,there are negative impacts on China's foreign trade when used as a means of trading protection.China is facing increasingly severe green barriers from developed countries in footwear industry,which requires immediate resolution as possible.Green barriers decrease the number of our footwear export as well as increasing export costs and trading frictions with other countries.The reason for these negative impacts is because of China's low involvement in international environmental regulations and the insufficient application of dispute settlement mechanisms of WTO.Besides,the legal system in China ranges widely and the regulations are mostly principle-based in lack of corporations across enforcement departments;Green standards are not set up properly and have low requirements,the warning mechanisms are to be established as well.To resolve these issues,China should respond accordingly from both international laws and national laws perspectives.Regarding international laws,China should strive to play a more active role in the international environment law-making and take advantage of dispute settlement mechanisms of WTO.Regarding national laws,we should keep improving our legal systems as related to environmental protection and footwear products quality and safety standards;establish a legal system to measure footwear products quality and safety;create a systematic database along with a warning mechanism regarding footwear products.
