Although the ownership of underground parking place in residential districts have been stipulated broadly by stipulation 74 in Property Law,it's still controversial.Proprietary parts of them,which have the independence of the construction and the utilization,and it can be registered the form of the right of apartment building.It can also be separated from the constructions as independent transaction.According to the contract,the proprietorial right of them belong to the developers,later it can be owned or used by proprietors.If the area of underground parking have shared of building area,the ownership of common parts of underground parking belong to the proprietors.The underground air-raid shelter,usually used for the parking lot,on the basis of regulation of “who spends money,who possesses right,who benefits”to ensure the ownership of it.Only underground parking can be registered the object of condominium and Law establish underground space as a right,can the proprietorial right of underground parking place be registered.China Law should unify the registration of organization,book,reason and information platform,to perfect specifically the system of the ownership of underground parking place in community.
