Study On The Law Issues Of Single Women's Freezing Eggs

Fertility is the most basic social activity by humanities.It's not only a natural event,but also a social behavior,which is universal to the legislation.In China's legal system,fertility is regulated in the light of family planning,while there are few regulations about exertion and protection of reproductive rights.In recent years,age and number of single women increase substantially,and assisted reproductive technology developed,which have promoted the discussion on the subject of the exercise of reproductive rights.Based on the current situation of the amendment of the law and single women's freezing eggs in China,this paper attempts to explore the problems and causes of single women's exercising reproductive rights via egg freezing technology.The thesis tries to discuss the theory and reality of single women's reproductive rights,on the basis of summarizing existent academic achievements,then approves of the dominant position and mode selecting of single women's rights from the angle of what ought to be and what is.At last,the author puts forward some suggestions on how to use the technology to protect rights in China,tries to push forward the progress of protecting single women's reproductive rights via the application of egg freezing.The main content is divided into four parts.The first part mainly analyzes problems and causes of Egg freezing via talking about the cases of female stars' freezing eggs overseas,then introduces problems from reality and law.The second discusses the related theory,proves that eggs freezing is a way for single women to exercise rights.This part is about connotation and basis in terms of theory and practice,to prove that single women have the reproductive rights,then proves that technological development of Egg freezing helps the realization of reproductive rights based on the nature of freezing eggs and the contents of reproductive rights.In addition,the thesis affirms the value of freezing eggs for single women.In the third part,the thesis puts forward some suggestions on legal issues of freezing eggs in order to exercise reproductive rights,from the angle of rights protection and necessary restrictions.On one hand,the thesis provides protection for single women's freezing eggs from the angle of systems and the others,on the other hand,it limits the exercising of single women's reproductive rights taking account of relevant factors.
