| Reproductive rights are basic human rights that every citizen enjoys equally.At present,some single women in China are increasingly demanding for the protection of reproductive rights,and there are more and more judicial disputes related to single women’s reproductive rights,and all walks of life are speaking out to discuss the realization of single women’s reproductive rights.Therefore,in order to better adapt to social development and respond to social needs,it is necessary to make specific and detailed provisions on single women’s reproductive rights from the legal perspective to ensure that new things are legally enforceable.This paper takes single women’s reproductive rights as the research object,and analyzes the justification,necessity and feasibility of guaranteeing single women’s rights by using the literature research method and other detailed methods,and argues that the basic idea of guaranteeing single women’s reproductive rights should be realized,and at the same time,puts forward the difficulties faced by the current protection of rights The legislation in China does not specify the reproductive rights of single women,and the only relevant legal provisions are conflicting and lagging,and the use of artificially assisted reproductive technology by single women is restricted,and there are many opposing views in the academic circle on the realization of reproductive rights of single women.Based on the above problems,this paper proposes a corresponding legal protection path for the realization of single women’s reproductive rights.On the one hand,this paper argues that legislation should be enacted to clarify single women’s reproductive rights from the constitutional perspective,and that conflicting laws should be clarified and amended as soon as possible,and the remedies for infringement of rights should be improved.On the other hand,the enjoyment of any right is limited,and single women’s reproductive rights should be strictly restricted.In addition,relevant institutions and policies should also make supporting provisions to jointly protect the rights of single women to reproduce through human assisted reproductive technology. |
