Research On The Standardization Of Evidence Collection For Food And Drug Safety Crimes

In recent years,food and drug safety crimes in China emerge in endlessly,which not only disorder the socialist market economy,seriously damage people's lives and health,but also make people question the government supervision departments,and bring adverse impact on the government credibility.One of the reasons is that the public security organs are constrained by various negative factors in the investigation of food and drug crime cases,which leads to the lack of standardization in investigation,and makes it difficult to collect evidence timely and entirely so that the attack to this kind of crime is weak.To effectively curb and combat against food and drug crimes has become an important task for the public security organs at present.Combining with the reality of food and drug cases investigation,the thesis analyzed the problems existing in the work of investigation and evidence collection of food and drug safety cases,and tried to summarize the countermeasures for the standardization of food and drug cases on the basic of the analysis.The first part is the overview of food and drug crimes.According to current laws,this part defined the concepts related to food and drug crimes,“Amendment to Criminal Law(8)” specifically distinguished the modifications of food and drug crime cases,particularly analyzed the accusations involved in food and drug safety crimes.It started with the main characteristics of current food and drug crimes and laid the foundation for the following discussion.The second part is the negative factors constraining standardization of food and drug crime cases investigation.From theories to the practice of the public security departments investigation of food and drug safety crimes,it analyzed the negative factors constraining standardization of food and drug crime cases investigation from aspects of the construction of investigation main force,evidence collection and fixation,food and drug identification and execution cohesion.The third part is the standardization of evidence collection of food and drug crime cases.It introduced the general principles of standardization of evidence collection and the relationship between the food and drug cases and the standardization of evidence collection.The review on investigation of extraterritorial food and drug cases demonstrated the importance of standardization of food and drug cases investigation.The fourth part is the standardization construction of food and drug cases evidence collection.It put forward corresponding ideas and countermeasures to improve the negative factors constraining the standardization of evidence collection in the aspects of the standardization of evidence collection processes,specialization of evidence collection subjects,certainty of evidence collection objects and promotion of evidence collection technology.
