On The Study Of Evidence Collection In Drug Crime Cases

The evidences of drug-related crimes are the basis of promoting the whole drug crime litigation and ultimately criminalizing the crime of drug offenders.and they are also the core of the judicial activities against drug crimes.Drug crime cases,therefore,according to its own characteristics,how to use various investigation measures and special material detection methods to collect evidences,aiming at the problems in evidence collection,suggestions to perfect the evidence collection,are the focus of this paper.In view of the current plight of drug crime evidences,I base on Chinese criminal law,Chinese criminal procedure law and relevant judicial interpretations,combining with the working practice engaged in drug cases examination for many years before prosecution.The study of evidence collection of drug cases and dealing with drug cases will provide some references for the future.This paper is divided into three parts:The first part expounds the characteristics of the evidence of drug crime cases.Against drug crime cases there is no specific victim,so the investigation mode of drug crimes is mainly from "people" to "case";sites of drug cases are not obvious and hidden,I show some more specific features of drug crimes in my paper.This paper expounds the characteristics of drug crime evidences.The evidence characteristics of drug crime cases are mainly reflected in their relatively unitary,un-stability,and the particularity of acquisition and so on.The second part expounds the evidence collection of drug crime cases.Based on the characteristics of the evidences of drug crimes,I put forward that the evidences of drug cases are mainly collected in a comprehensive and timely manner.Collection methods of drug crime evidence and the ways are the core part of this article.There are many other evidence collection methods of drug crimes.I combine various methods with my judicial practice,focusing on the fact that it may be sentenced to fixed-term imprisonment of not more than 15 years,life imprisonment or death penalty cases of drug smuggling,trafficking in transporting.I mainly discuss how to collect evidences surrounding specific objects,through "one stem,four branches" methods and the uses of special investigative measures for evidence collection.Due to the difficulty of detecting and obtaining evidences during drug crimes,there are many problems in the collection and fixation of drug crimes,and there is mainly evidence of illegal and irregular collection of evidences.The third part,there are some suggestions on improving the evidence collection of drug crime cases.Due to some problems such as illegal,not standardized methods of obtaining evidences in the course of evidence collection,combining with my own judicial practice and my daily working experience,I put forward my own opinions and discuss in details from 4 aspects of strengthening consciousness in investigation,improving evidence collection abilities,strengthening the consciousness of evidences,perfecting the evidence collection,standarding the collection of evidence in drug crime cases and using special investigation means to obtain evidence of the efficient conversion of materials.
