Research On The Legal Problems Of The Taxi Regulation In China

With the rapid development of China's economy,the taxi is different from other public transport modes,which is comfortable,convenient,fast and wide range of services.At the same time,the taxi industry has the property of public and market,which has the characteristics of independent,decentralized and individual service.Because China's taxi industry for a long time the franchise,the government strictly control the total amount of the taxi,the taxi market there is a situation of imbalance between supply and demand,"Taxi strike" events occur frequently in all parts of the country.After six or seven years of appeal,discussion,in 2015,the government finally decided to start reform.But the taxi reform involves the interests of the government,taxi companies,drivers and other subjects,taxi difficult problem,black car prevalence,low income drivers,poor quality of service and other issues make the reform difficult.Although the causes of these problems are different,but most of the taxi industry and government supervision after all relevant government regulatory policies of the taxi industry has become the focus of social concern and troubled government legislation and law enforcement difficulties.Therefore,this paper tries to analyze the legal problems of the current government regulation of the taxi industry in our country from a legal perspective,and puts forward some specific regulatory policies and legislative proposals,hoping to provide some new ideas for the construction of the government supervision mode of China's taxi industry.The first part of this paper describes the properties and characteristics of the taxi industry,introduces the general theory of government regulation,analyzes the legal relationship between the government regulation of the taxi industry in our country,for the development of this chapter is the theoretical foundation for the following discussion.In the second part,from the legislation,running two aspects introduced the basic situation of government regulation of the taxi industry in our country,and then from the legal system,franchising,specific control measures and the government law enforcement responsibility to implement the four aspects of the legal problems of current government regulation of the taxi industry in our country is the key,in order to highlight the seriousness of the problem with the research.The third part for the third part of the legal issues,find an antidote against the disease,from the improvement of the legal system,will use the taxi industry into the general permission to develop standards of various control means and the balance of the taxi industry government supervision responsibilities of these aspects,and puts forward some concrete suggestions to solve these problems.
