With the continuous development of Internet technology in recent years, the way to take a taxi is no longer limited to traditional roadside recruit. In our daily life, we have preferred to catch a cab through internet, for example an efficient app on cellphone. A large number of private cars are connected to the network platform about taxi with the emergence of taxi rental company on web, citizens has enjoyed the convenience but at the same time the new phenomenon caused extensive controversy. Taxi belongs to the franchise industry in our country, there are strict standards of admittance into industries. The government encourages the market innovation, meanwhile, also has emphasized that private cars accessed into taxi rental platform is prohibit. Those cars without permission are so-called’black/illegal cars’. This paper tried to analyze the problems caused by the new taxi industry form, the management status of government for the new and old taxi industry form, the government’s position during the transformation of the taxi industry, putting forward the new path for taxi industry under the new industry form on the basis of the experience of foreign governance.Despite the introduction and conclusion, this article consists of four parts:The first part is the current situation and problems of the taxi industry regulation under the new form. This part firstly define the definition of taxi, car and taxi rental on web, and briefly introduce the present situation of the regulation of traditional taxi industry. Such as the strict rules of access way, quantity, price, and service quality. In this part, I have talked about the debate between the moderates (Ministry of Communications) and the hardliner (local government), but they both agree to prohibit the access of private cars. There are two questions under the new taxi industry, the controversy between the Traditional permission and Franchise permission and the controversy about the legitimacy of taxi rental on web.The second part is the theory basis for the development of the taxi industry. The taxi industry form transformation is not only the need of market competition, it still has profound theoretical foundation, such as establishing the liberty and order of a government of law, responsibility of the government regulation theory, the government protection under the shared economic development and so on.The third part is foreign government experience in the new form of taxi industry. This part mainly introduces the management experience of the major foreign countries. British taxi industry management result is outstanding, Government takes classification regulation for the industry, makes a clear definition between taxis and private carriages and sets different regulation standards. California in USA makes a concept of "traffic service" and put forward mandatory requirements. In France, taxi rental on web is forbidden because of the big conflict between the taxi drivers and the rental car drivers. Thus, the taxi rental companies such as UBER has made an appeal to the European court. Australian taxi rental reform is under discussion and has come out a reform thinking.The fourth part is the new idea of the path of legalization of new taxi industry format. This part firstly made a clear government position during the path of legalization, and propose new ideas of the legalization of taxi industry under the new industry form from two aspects:administrative legislative and regulatory enforcement. This part puts forward the reform ideas of taxi industry access standards and control measures, and try to build new management model for taxi rental on web to meet the diverse needs of the market.
