Ages Rural Old-age Right Legal Protection System Research

In the 21st century,the aging of rural population becomes intensified with rapid development of economy and society in China.As a constitutional right,old-age right of farmers is related to farmer's well-being,social development and national stability and attracts"growing" concerns in nowadays society.Moreover,there are increasing problems in the protection of famers' old-age right.Therefore,it has great practical significances to study the legal safeguard mechanism for famers' old-age right.Based on the concept of equal rights,rural residents should enjoy the same old-age rights and interests as urban residents.However,the old-age rights and interests of urban residents are greatly satisfied and rural residents cannot fully enjoy the old-age rights and interests in the practice process.There are still a series of problems in the realization of famers' old-age right such as weak family protection efforts,Imperfect social organization safeguard way and unsound national guarantee systems.Therefore,the pension rights of the rural residents have certain special characteristics relative to the urban residents,and the implementation of their pension rights needs to improve the legal system.The aging of population undoubtedly and increasingly highlights the defects and flaws in the legal protection system for famers,old-age right,which makes it more necessary for the farm families to lay emphasis on the material and spiritual needs perfecting social security system organization.Meanwhile,the state is required to take various measures such as improvement of related legal systems,intensification of law enforcement efforts and perfection of mechanism for judicial relief so as to effectively ensure famers' old-age rights and interests.
