Study on the registration object of residential house is an extremely important part of unified registration of real estate,is to ensure the legal basis of the house rights and house transactions transparent and safe,is the cornerstone of the development of a healthy and stable real estate market and is the premise of the unified registration of real estate in China.At present,laws and regulations and local norms of residential have less provisions of registration object of residential house,or even conflict.Firstly,this paper clarifies the basic concepts related to the registration object of residential house that with a fixed boundary,which can be used independently and has a clear and unique number.Registration object of residential house can be confirmed by its basic characteristics of the legitimacy,the fixed,the permanent,the independence and the residence.This paper is based on the research of the condominium ownership,although our country has basically established the system of condominium ownership,but the provisions are more principled,there are still many problems in the practice.Secondly,in this paper,the definition of the exclusive parts and the common parts of registration object of residential house are defined and put forward the principle of definition.The exclusive parts can be confirmed by the comprehensive of the wall and the space,and the common parts is confirmed by the three cases,which are used by all or part of the owner of the property to be used together,or set up in a legal way to be common or not exclusive part,municipal public part and other obligee.Finally,through the comparation of "Code for calculation of building area","House Property Survey Specification" and "Technical specification for Jiangsu housing area measurement",this paper put forward its own views for the controversial provisions in both of building technology and legal theory.Some feasible suggestions are put forward for the calculation of the use area,the inner wall area and the balcony floor area.In this paper,it is not reasonable to share some part of common parts to the owner of each household,and puts forward some reasonable suggestions on the registration of the common parts.
