| Drug problems is one of the biggest problems around the world and it's a public nuisance in society.At present,the main basis for drug control work is Drug Control Law of the People's Republic of China and Drug Control Ordinance.These two laws and regulations constitute the main framework of drug control and detoxification system in China.The Drug Control Law prescribes the main measures for detoxification,including drug treatment,community detoxification,and compulsory isolation detoxification.This article will select compulsory isolation detoxification;focus on the implementation and defects of the compulsory isolation detoxification system.Hopefully it makes suggestions for defects in the compulsory isolation detoxification system.The basic framework of this article is divided into four chapters.To preliminary study,explore and cogitate from the progress and development of compulsory isolation detoxification system,the implementation and defects of the existing system,and propound the fixed suggestion of the system.Clearly pointed that the public security organs withdraw from the isolation detoxification system and the judicial administrative organ has full executive power,carry out the universally applicable isolated management education mode in nationwide,establish a specialized and institutionalized diagnostic evaluation mechanism,improve the management of the isolated people who has AIDS and other special diseases,lead the procuratorate into intendance,sorting out the procedures of compulsory isolation detoxification,fully protect the rights of drug addicts,clear the legal statutes of drug rehabilitation police,improve police management system,etc.The purpose is to provide a practical and operational legal reference for the development and perfection of compulsory isolation detoxification system in our country.Make it a standard,rigorous,scientific and efficient drug rehabilitation legal system.Serving the goal of "drug free society". |
