Study On Legal Issues Concerning Rules Of Origin In China-south Korea Free Trade Agreement

The current international trade is developing towards globalization,regional economy also gradually shows the tendency of integration.To improve the level of economic development,many countries began to conform to the trend of globalization and regional trade cooperation with neighboring countries,and the inevitable result of the regional trade cooperation is the signing of the free trade agreements.Rules of origin plays a key role in the FTA,which determines the success of the fta.At present,our country also has established regional economic cooperation relations with many countries.Therefore,we should pay more and more attention to the function of rules of origin,and the research on the rules of origin of the FTA has an important guiding significance.China-south Korea FTA as the first free trade area of northeast Asia,has a very important demonstration significance,studying and correct understanding on rules of origin of China and South Korea free trade agreement and its implementation procedure,will not only promote the economic development of the two countries more effectively,as well as the economic sovereignty of our country.This paper firstly expounds the basic theory of FTA rules of origin,including connotation,elements and classification of the rules of origin,and then introduces the relationship between the FTAs and rules of origin.And also gives a brief introduction on the Rules of origin in FTAs China has signed.Secondly,the paper elaborates the content of rules of origin in China-Korea FTA,and on this basis,analyzes characteristics of China-Korea FTA rules of origin comparing with the Rules of Origin in other FTAs China has signed so far.Meanwhile,this paper also summarizes the implementation of the Rules of Origin in China-Korea FTA since it has been signed over a year.And,on the basis of comparative analysis with NAFTA and CAFTA rules of origin,combined with the practice of trade,this paper analyzes the advantages anddisadvantages of the rules of origin in China-Korea FTA.Finally,on the basis of the above study,related Suggestions are put forward for the perfection of the rules of origin of China-Korea FTA.
