The Research On The Problems Of Legal Belief With The Law-based Governance

Laws and regulations are maturing with the law-based governance developing in our country.However,due to the high attention about the creation of legal system,legal belief in a certain extent,was ignored.Nowadays,the problems of legal belief in our country,has restricted the development of the Law-based governance.This paper will start from the basic problems of the law-based governance and the legal belief and use the methods of literature research and the combination of theory and practice to analyze and discuss the problems of our country's legislators,law enforcement,judicial and law-abiding.It will point out that the problem of law faith in the current China's legislators,law-executor,judiciary,law observant,including legislators' legal quality is difficult to adapt to the high technical requirement from legislation and lawmakers are beyond their power to make the law;Law-executors' failure to observing the law,law-executors' impotence to enforcing the law,abusing the power and seeking the personal gains;The judicial professional ethics level needs to be improved and the phenomenon of corruption,the prohibition for selfish always happen;Law observant lacks the law knowledge,weakens the law concept and lacks the consciousness of law-abiding.Also it will analyze two reasons of the problems about legal belief from the history and reality,including the historical reasons of self-sufficient natural economy of feudal society,the feudal monarchy and the feudal traditional legal culture of long-standing inhibits the formation of legal faith,whose realistic reason includes judicial fairness problems of legal instrumentalism,scientific legislation,strict law-enforcement as well as the the work of popularizing laws that has been just only focused on the formality.Cultivating the legal belief of the foreign countries are introduced,including summarizing of construction the rule of law society countermeasures in Singapore,Japan,Germany,this paper focuses on the current problems on the legal belief of social public in our country,relating to the countermeasure about the problems of causes of cultivating law faith,including developing the socialist market economy,improving the socialist democratic politics,strengthening the cultivation of humanistic spirit to create a good social environment,cleaning the influence of law instrumentalism,advancing the scientific legislation,strictly enforcing the law,administrating fair justice and further developing thework of legal belief and vigorously strengthening the popularity of education to promote the development of the process of the law-based governance.
