Research On Civil Liabilities Of Personal Information Right Infringement

In 1964 the world's first computer was created in the United States,marking human enter into the information age.Accompanied by the popularity of the Internet,personal information security and national information security are becoming more and more important.Modern technology makes it much easier to collect,save,transport,process and utilize personal information,either the information dissemination speed or processing speed or application degree have increased dramatically.But personal information was the most extensive and most vulnerable form of information.By the growth of large data technology in recent years,personal information is transformed into an important economic resource.However,all kinds of illegal sales,abuse,theft and other violations of personal information are happening endless and endless for the purpose of making money.Especially in recent years,the infringements caused huge economical losses and metal damage to the victims;some of them even committed suicide,and attracted widespread social attention.China's existing legislation on the protection of personal information right is not perfect;the civil liability provisions of violation of personal information rights are almost blank,such a situation is impossible to protect the rights of personal information.This paper starts from the analysis of personal information security crisis in the context of large data age,and exhibited the latest research results of civil liabilities of personal information right infringement both domestic and abroad.The author designed three forms of civil liabilities for personal information right infringement,in order to constitute the liabilities into a comprehensive mechanism.The author designed a compensation mechanism and relative procedural mechanisms in order to balance personal information security with the development of modern Internet Industrials,and ultimately promote the orderly development of society.
