Research On Copyright Protection Of Network Digital Music

As the Internet grows rapidly,digital music published on the internet is becoming part of our daily life,which significantly changes the traditional music industry.So research on copyright protection of digital has considerable values,both academic and commercial.The copyright law serves a purpose of balancing the interests of copyright holders and consumers,as well as creating a fair and health environment for the development of digital music industry on the Internet.At the same time,the legal nature of digital music has become very different from that of the traditional music works.With increasing number of copyright related legal disputes in recent years,it has been a consensus that a complete and systematic set of law and regulations,in line with China's current condition,for digital music copyright protection is necessary.The experience on this issue from other developed countries is leveraged by studying related domestic and international publications and books,and by comparing Chinese and foreign policy and regulations.After analysis on typical cases in the background of current law amendment,I expressed my opinion on copyright protection of digital music on the Internet for reference: they key is to establish and complete the protection regulations,complete the collective management of copyright,clarify the boundaries of rights and responsibilities,perfect the cause of defense related regulations etc.In this paper,the audience will better understand the current status of digital music copyright eco system on the Internet by the introduction of basic characters of digital music and its applications.We will also explore the involved legal issues i.e.the balance of public and private interests as well as the conflicts between justice and efficiency in digital music copyright protection by introducing the related concepts in digital music and its legal relations.For the comparison of China and foreign countries,we will summarize the advanced experience from developed countries on copyright protection like the United States,Japan and Germany.And we will explain in detail the related content in 3rd amendment of our copyright law,trying to pinpoint the problem and provide solutions accordingly.Then we will start with real world cases and analyze judicial and administrative aspects of China's digital music copyright protection,specifically on the exposed issues related to responsibility definition of infringement and absence of management of multiple causes of defense.Then we will categorize and generalize the issues exposed in real world cases and provide practical solutions like completing law and regulations,clear definition of responsibilities and digitalization of the copyrights registration conflicts resolution.
