Study On Digital Music Copyright Protection Under The Circumstance Of Internet

The war of digital copyright lawsuits has been several years in China, and behind the veil of the copyright litigation is the weak intellectual property protection for digital music and the serious situation of digital music piracy. Meanwhile, the digital music industry, even in developed countries, is also going through the challenge of internet technology. Therefore, legal transplants are not effective ways solving the problems faced by the current copyright protection for digital music. How to deal with the failure of copyright law caused by internet technology development is the core of this thesis. Around the core, the paper is broken down into five sections, in order to discuss the problems step by step and find the best way to solve those issues.The first section is introduction, which offers the background of the mentioned issues, simply analyzes current situation and difficulties of developing digital music industry, and provides basic information of related litigations and research in China and foreign countries. In addition, this section helps to distinguish the related definitions and is necessary to put foundation on making research in digital music copyright. The second part emphatically analyzes the variation of music spreading behavior and music copyright licensing behavior under the Internet environment.The third part introduces different solutions regarding digital music copyright problems and offers brief analysis. The fourth section, firstly is introduction around the history of legislative reform of American copyright system, trying to go back to legislative environment and dredge the essential theory of music copyright, for the sake of changing the stiff situation of law transplants and preparing for local legislation; Next to the gain and loss of the third time modification of copyright law of China on digital music copyright. The last part combed through analysis results of digital music copyright concerns from different perspectives, so that it ended up with a information-based specialized and market-oriented copyright reform view which started with the collective administration of copyright and licensing.
