Inheritance And Reform:A Study On The System Of The Judge Assistant Form The Perspective Of The Professionalization Of Judicial Personnel

The judge assistant system is designed to clarify the division of labour among judge,judge assistant and clerk in judicial practice especially in the trial practice of case;which emphasizes the common but distinguishing role orientation and responsibility requirement of judicial professionals in judicial adjudication activities.The setting of the assistant judge can help the judge to complete a series of matters with lower professional requirements,thus saving the judge's time and energy.Through the model of the judge-judge assistant-clerk,the role of each role should be played.Form a division of labor and a trial team to further improve the efficiency of the judiciary and alleviate the contradiction between the number of people and the small number of people.At present,China lacks a vocational system reform program specifically for judge assistants.Combined with the practice of the judge assistants in China,we find that there are some bottlenecks in the construction of the judge assistant system.The reason is because the assistants of the judges are unclear and the synchronization supporting mechanism is not in place.Equipping judges with excellent trial assistants is conducive to helping judges return to the "referee"standard,thereby improving the effectiveness of judicial adjudication,and the reform of the trial support staff system is imperative.This paper,from the angles of theory and practice,analyzes the four five-year reform programs about the changes of the judge assistant reform,and grasp the development direction of the judge assistant team macroscopically.Besides,this paper makes a sample analysis on the operation mode of the judge assistant in various parts of our country,and sums up the practical experiences and existing difficulties of the judge assistant reform.On the basis of local practice,this article compares and analyzes the systems of the assistant judge and judicail auxiliary personnel in two legal systems,and explores this system.The paper uses four research methods,such as historical analysis,comparative analysis,empirical analysis.There are four chapters in this article.The first chapter defines the judge assistant system and its function,and then combs its developmentThe second chapter introduces the pilot status of the judge assistant in chinese courts,summarizes the bottlenecks in judicial practices,and analyzes the reasons for its existing difficulties.The third chapter introduces the judge assistant system in foreign countries,which can provide references and supports for the construction of that in our country.The forth chapter puts forward the reform path of the judge assistant system in combination with the above analysis.
