Study On The Protection Of The Copyright Infringement Of Wechat

This paper discussed the copyright infringement of Wechat under the background of the Internet.In 2011,the Tencent company launched the internet applications Wechat which has been the favor of the people since then,and the Wechat made the people's life colorful as the typical representation of the self-media area.On 28 th January,2015,Wechat pushed out the PC client which increased the users of the Wechat in a large degree.Wechat was well received because of its own advantages.Wechat released information fast and interactively,and communicated conveniently,it is very conducive to timely communication.Wechat brought the convenient and fast communication and promoted the cultural transmission,meanwhile,it brought many disadvantages,in which the most obvious one is the copyright infringement problem.The copyright infringement seriously violated the rights of copyright owners of Wechat works,and disturbed the Internet and Wechat platform network order more seriously.From the above point of view,combined with domestic and international relevant legislative practice experience,the author studied the copyright infringement and protection of the Wechat platform,and put forward many ideas and suggestions for improving the copyright infringement of Wechat.At the first,this paper explained the research significance of this study.Thereafter,the author introduced the relevant legislation and the research background of China and the other countries.The foreign Twitter and Facebook were compared with the Wechat to find the similarities and differences aiming to find the experience of the relevant legislation in foreign countries.After that,the author introduces several research methods such as literature survey,comparative study,case analysis and so on.In the last part of the first chapter,the author introduces the three innovation in this paper,including the summarizes of the characteristics of Wechat,the propose to increase Wechat network service provider's obligation to assist in the investigation and put forward the improving Wechat infringement evidence system,which is also the highlight of this study.The second part of this paper,the author mainly introduces several characteristics of appeal rights of what Wechat and Wechat works such as transmission range is relatively closed,allowed others forwarding habits and copyright urgently etc.In the third part of this paper,the author makes a detailed analysis of the main body of the Wechat platform,as well as the identification of infringement.In the fourth part,ultimately,increasingly common for tort,combined with the status of development of the Internet under the background of the Wechat platform,analyzes the related reasons.The fifth part of the article,on the basis of the above analysis,focuses on the analysis and description of the solution to improve the infringement of Wechat's actions.In summary,from the above research background,put forward problems,analyze the reasons and find out measures,the author study on Wechat works infringement problems a systematic and complete exposition,hope to work together through multi subject,find out the way to improve the relevant Wechat tort.
