Research On Infringement Of Wechat Public Platform

Wechat public number since 2012 officially launched,so far,has more than 20 million registered account number,countless daily production and dissemination of information,the impact of the public life penetration into the dribs and drabs.However,the development of wechat public platform is also accompanied by many negative problems,which bring us new information experience and a series of intellectual property rights infringement problems.Wechat public platform is very different from the traditional information media,compared with other emerging network media also has its special nature,and most ordinary wechat users do not pay attention to the existence of intellectual property rights,property rights protection consciousness is relatively weak,wechat service provider’s supervision is limited,the relevant laws and regulations due to the formulation of a long time and other reasons make the phenomenon of intellectual property rights infringement repeatedly banned,intensified.In order to balance the communication function of wechat and the conflict of interest between protection,it is necessary to study intellectual property rights infringement on wechat public platform.Firstly,this paper briefly introduces the background of wechat in China.based on the analysis of the research status and the research purpose and significance of wechat at home and abroad,this paper expounds the related theories of wechat copyright,including the basic concept of wechat public number,the legal definition of the infringement of wechat public number,and the current situation of the infringement of wechat public number.Then introduce wechat public number infringement of intellectual property rights types,analysis of copyright,trademark and patent rights concepts,types and wechat public number infringement of intellectual property rights analysis.The most important part of this paper is to summarize and analyze the particularity of wechat public number infringement of intellectual property rights,through the analysis of wechat public number infringement subject,object and wechat public number infringement of particularity,more comprehensive and detailed understanding of wechat public number intellectual property rights infringement.Finally,it analyzes the difficulties of intellectual property protection of wechat public number in China.The main difficulties of protection are the lag of relevant legislation and the ambiguity of judicial interpretation.The tort liability of network service provider is imperfect;The lack of collective intellectual property protection consciousness;The benefits and costs of the process of safeguarding rights are disproportionate.Combined with the reality of China’s legislation,put forward suggestions on the construction of wechat copyright protection system,to further improve the relevant laws and regulations;Wechat network service providers should strengthen supervision;Raise awareness of collective intellectual property protection;Advocate the establishment of wechat platform within the industry self-discipline organization.Based on the above discussion,the conclusion is drawn that the protection of wechat public number intellectual property rights not only needs perfect laws and regulations,but also needs the self-discipline of network users and the protection of wechat platform.through joint efforts of many parties,the legitimate rights and interests of intellectual property rights holders can be jointly maintained,so that wechat platform can develop orderly.
