The Conflict And Coordination Between Justice And Public Opinion

Our country is in the construction of a socialist country under the rule of law,the social public to enhance consciousness of rule of law,the desire of the public opinion is increasingly intense,with the progress of science and technology,public opinion expression channel is more and more rich,some influential cases under the network media and promote,caused the extensive concern of the public,also contributed to the problem of justice and public opinion of social awareness and influence;Nowadays,in the judicial reform,the conflict between justice and public opinion has become a focus problem in the process of the rule of law,and how to coordinate public opinion and judicial is a problem to be solved.In this paper,based on this topic,is cut with typical cases,from the Angle of the theory of contact specific case analysis,demonstration of public opinion can play what role in the judicial,through the horizontal comparison,both at home and abroad on how to coordinate the conflict between justice and public opinion on concrete is discussed.This paper is divided into five parts.The first part analyzes the concrete manifestation of judicial and public opinion conflicts in the typical case.The second part analyzes the relationship between the judicial and public opinion.The third part analyzes the coordination between foreign judicial and public opinion,and provides reference for the coordination of judicial and public opinion in China.The fourth part,based on the previous analysis,probes into the concrete ways of coordinating the judicial and public opinion conflicts in China from five aspects.Public opinion to the judicial involvement,the fifth part is epilogue,does not necessarily affect the independence of the judicature,public opinion on the play the role of supervision and judicial fairness,to coordinate the relationship between public opinion and judicial is a long-term task,need to improve in the process of comprehensive law.
