According to Article 25 of the new “Consumer Protection Law”,the consumer will have the right to regret in the new shopping mode,such as Internet,TV,telephone and mail order.As a tilt protection for consumers,the system of regret right has been clearly reflected in the multinational legislation.The establishment of the system of regret right in our country is to comply with the demands of market economy development,which embodies the principle of fairness and justice in the concept of socialist rule of law and the principle of efficiency in economic activities.To protect the legitimate rights and interests of consumers,it is necessary to introduce the system of consumer's regret right and study on it.To ensure the system of consumer's regret right be better applied in practice,this article starts from the concept of this system,then studies its legislation pattern,and then compare the Chinese and foreign regret right to discuss the scope and the application of this right.Hope to provide suggestions of improving the system of regret right.The article is divided into five parts.In the first part,the essence of the conception of regret right is summarized through the comparison of different titles of regret right.The value of consumer's regret right in online shopping is also discussed.The second part focuses on the foreign and domestic laws,so as to summarize the excellent legislative experience and lays a foundation for further study on the legislative model of the regret right.In the third part,the article analyzes the legislation concept and the specific legislative mode of regret right by analyzing the interests of the business operators and consumers.The fourth and fifth parts respectively study the scope and application period of the consumer's regret right,with a view to provide legislative suggestions for further clarifying the scope of application and the application period.
