Study On Local Legislation Of Public Participation

As an important democratic system,public participation in local legislation has profound theoretical and practical significance.The western countries carried on the corresponding reform to the legislation in the delegate government period in nineteenth Century,and established the public participation legislation system.With more of our interest differentiation and interest stratification,the original "departmental protectionism" and "closed door legislation" defects have become increasingly prominent in China,at the end of the last century in the law gradually increased the principle provisions of public participation in local legislation,to the stage,the relevant local legislation in our country the regulations are provided with plenty of space to the system of public participation in legislation.However,China's current laws and regulations on public participation in local legislation and western developed countries still have a certain gap.In this regard,this article from the concept of public participation in local legislation and relevant theories,through combing the relevant provisions of laws and regulations in China and abroad and the practice of our country,to improve public participation in local legislation and put forward some suggestions.First of all,this paper explains the background and significance of the research,the status quo of the research at home and abroad,research ideas and methods,as well as innovations and shortcomings.Secondly,through the definition of related concepts of public participation in local legislation,defining the research object of this paper,starting from the people's sovereignty theory,in view of the theory of democracy and deliberative democracy theory,the theoretical origin of public participation in system of local legislation were elaborated.Furthermore,according to the public's right to know,right to participate in and supervisory authority of the "constitution","legislation" and much of China's local legislation regulations on open legislation,public participation in the legislative scope and approach,feedback mechanism and legislative supervision of the relevant provisions of the systematic research and analyze the lack of public participation in local legislation,such as legislation,public participation in the public is not fully involved in the scope and way of limited legislative organs,lack of feedback mechanisms,public participation and supervision is not clear.Then,through the United States,Switzerland,Japan and the relevant provisions of the local legislationof public participation in China's Taiwan region and practice discussion from two aspects and deduce the perfection of public participation in local legislation system in china.Finally,combining the experience and the lack of public participation of local legislation in foreign country our country,put forward to perfect suggestions of the public participation of local legislation in our country,namely strengthening the legislation of public participation in public and enrich the scope and means,build an effective feedback mechanism and clear public participation in local legislation and supervision system.
