Criminal Regulations On The Internet Non-public Equity Financing Behavior

The development of the Internet non-public equity financing is an irresistible trend.It is an important part of the equity field,and the criminal risk of it is concentrated as the crime of illegal fund raising.Based on the previous research,this paper starts from the definition of the concept of non-public equity financing on the Internet,and analyzes the difference between the legal financing behavior and the illegal fund-raising crime from the two aspects : fund-raising and financing platform.In view of the practice,this paper points out that the concept of criminal law is far away from the social practice in the transitional period.Moreover,problems in the connection of the Administrative Law and the Criminal Law obstruct the effective function of legal regulations.So we should retrospect the criminal law ideas,the penalty system and the criminal law explanation,adhere to the idea of modest restraining,update the concept of criminal law according to the development of society,let the integration of criminal law and administrative law more smoothly,build a system of misdemeanor to improve the legal sanctions system,explain the provisions according to the background to create a path of the transition of the traditional criminal law.
