Study On The Existing Problems And Countermeasures Of Illegal Buildings In Pingtan

Including Pingtan area,illegal building are ubiquitous throughout our country,with the rapid economic development and the continuous improvement of the urbanization level in our country.Taking Pingtan as the study area,this paper analyzed the main types,characteristics and causes of illegal structures from geography,economy and natural environment and other basic conditions.Combined with the actual management of the illegal buildings in Pingtan area,it is found that there are mainly five kinds of difficulties in the governance of illegal buildings.The first is the dilemma of the legislative system.The definition of illegal structures is not clear enough,the rights and interests are unknown,and a relatively complete legislative system has not yet been formed.The second is the dilemma of administrative governance.The cognizance subject is not clear for the administrative enforcement of the law,cognizance system is missing and the disposal methods are too simple that dismantling is the only means for the illegal buildings.The third is the regulatory dilemma.There is lack of regular regulatory mechanisms,an advanced regulatory approach and a clear regulatory subject.The fourth is co-governance dilemma.Making excuses mutually and omission is not uncommon.The fifth is civic awareness dilemma.Developers,migrant workers,and ordinary villagers always consider their own economic interests but less consider public interest.A four-dimensional mode of governance base on the analysis of the causes and governance dilemma of illegal structures in Pingtan area.On the legislative level,on the basis of upholding the principle of administrative legitimacy and administrative rationality,we should speed up the legislation,improve the relevant legal system,and establish a legislative system and a system for determining illegal building governance.At the law enforcement level,we should well identify the pre-procedure,the mid-course procedure and the post-trial procedure clearly,strengthen the procedural norms and improve the efficiency of law enforcement and the government's credibility.At the regulatory level,we should pay greater attention to the regulation of formulation and implementation about relevant laws and regulations and policies,administrative penalties and enforcement of illegal buildings,breeding of illegal buildings.At the education level,we should pay attention to the role of education,intensify the education on the rule of law,increase the intensity of information disclosure,and emphasize case education.
